Welcome to TenantSphere

Thanks for using our Services.

TenantSphere provides property management software to Businesses and is accessible via any internet-connected device. We also provide an Android and iPhone/iPad app.

If You browse any of our Websites or use any of our Services You agree to comply with and be bound by these Terms. These Terms are binding on any use of the Service and apply to You from the time that TenantSphere provides You with access to the Service.

These Terms are not intended to answer every question or address every issue raised by the use of the Service. It is Your obligation to ensure that You have read, understood, and agree to the most recent Terms.

By registering to use the Service you acknowledge that You have read and understood these Terms and have the authority to act on behalf of any person for whom You are using the Service. You are deemed to have agreed to these Terms on behalf of any entity for whom you use the Service.

TenantSphere reserves the right to change these Terms at any time and you are bound by such changes

Key Notes (Cameroon Market)

  • TenantSphere operates a curated marketplace: all landlord‑submitted rental listings are verified by the TenantSphere team before publication (Verified Listings).
  • Viewings/tours and certain workflows may be handled by vetted and trained TenantSphere Agents.
  • TenantSphere may publish its own listings (TenantSphere Listings) that meet our verification standards.
  • Verification reduces fraud and obvious inaccuracies, but is not a structural survey, legal title examination, or guarantee of condition. Perform your own inspections and due diligence.
  • Payments are in XAF and processed via licensed third parties (including mobile money operators MTN MoMo, Orange Money, and payment aggregators). BEAC/CEMAC rules may apply.

Definitions

Account

Your registered TenantSphere account.

Agent / TenantSphere Agent

A real estate professional using the Service; a TenantSphere Agent is vetted and trained by TenantSphere.

Data

Any data, content, files, or information you submit or upload.

Intellectual Property Rights

All IP rights worldwide.

Invited User

A person authorized by a Subscriber to access the Service.

Landlord

A property owner/manager listing or managing properties on the Service.

Payment Processor

A third‑party provider facilitating payments (including mobile money operators and aggregators).

Service Professional

Providers (e.g., moving, maintenance) who may receive assignments via the Service.

Subscriber

The person or entity that creates the Account.

Tenant

An end user seeking or managing rentals via the Service.

Verified Listing

A landlord‑submitted listing that passed pre‑publication checks under Section 6A.

TenantSphere Listing

A listing created and published by TenantSphere subject to verification standards.

Website

tenantsphere.com and any app or domain we operate.

You/Your

The Subscriber and, where the context permits, an Invited User.

1. Privacy & Data Protection

Our Privacy Policy forms part of these Terms.

You warrant you have lawful authority and consents to provide personal data of others, under applicable law (Cameroon law and, where relevant, GDPR).

We may process/store data on secure infrastructure (possibly outside Cameroon) with appropriate safeguards for cross‑border transfers. A Data Processing Addendum (DPA) is available where legally required.

2. Access Conditions

We grant a non‑exclusive, non‑transferable right to access the Service for lawful purposes per these Terms.

Keep credentials secure. Notify us immediately of unauthorized access.

  • Do not undermine security, impair functionality, attempt unauthorized access, upload harmful/infringing/illegal content, reverse engineer, scrape, or copy our data.

Minimum age: 18.

3. Account Verification (KYC) and Compliance

We may require identity/business/property verification (e.g., ID, proof of ownership/mandate).

You agree to AML/CFT and sanctions screening. We may restrict features if verification fails or risk is detected.

4. Intellectual Property

TenantSphere (or licensors) owns all IP in the Service (designs, code, databases, branding).

You retain ownership of your Data; you grant us a worldwide, non‑exclusive, royalty‑free license to host, store, process, transmit, display, back up, and use Data to operate/improve the Service. Public areas: you grant a license to display/use publicly posted content. Do not post unlawful, defamatory, discriminatory, or infringing content.

5. Listings, Tours, Messages, and Transactions

Listings are either Verified Listings (landlord‑submitted and verified by TenantSphere) or TenantSphere Listings (published by TenantSphere).

Prices, availability, and terms are provided by landlords/agents and may change.

Tours may be organized by TenantSphere Agents. Follow lawful instructions regarding safety/building rules and applicable fees shown in‑app.

Electronic documents and signatures may be facilitated and are legally valid where permitted by law. Unless expressly stated, TenantSphere is not a party to your lease.

5.1 TenantSphere Agents & Listing Verification

Agent Training

TenantSphere Agents are vetted and trained on platform use, code of conduct, anti‑fraud practices, and applicable Cameroonian laws/regulations. They may be employees or independent contractors. We may suspend/remove agents for policy breaches.

Listing Verification (Pre‑Publication)

  • Identity/KYC of the submitting party.
  • Proof of ownership/management rights or mandate.
  • Location and basic attributes consistency (type, rooms, size).
  • Media checks (photos/videos) and duplicate/fraud screening.
  • Basic consistency on price, fees, and key terms.

We may request documents, decline publication, annotate, or remove listings that fail checks or become non‑compliant.

TenantSphere Listings

TenantSphere may publish its own listings labeled accordingly and subject to equal or stricter verification standards.

Re‑verification & Delisting

We may re‑verify, annotate, correct, suspend, or delist any listing for accuracy, safety, legal, or policy reasons.

Limited Nature of Verification

Verification reduces fraud and obvious inaccuracies; it is not a structural survey, legal title opinion, or guarantee of habitability/fitness. Perform your own inspections and legal review.

5.2 Landlord/Agent Warranties for Listings

  • You have the legal right to advertise and let the property and lawful rights to submitted content.
  • Information provided is accurate, not misleading, and kept up‑to‑date (price, availability, material defects).
  • You will promptly notify TenantSphere of changes or issues (e.g., legal disputes, safety hazards, uninhabitable condition).
  • You authorize TenantSphere to conduct verification checks, request documents, and contact you for clarification.

Misrepresentation & Remedies

We may reject, annotate, or remove listings; suspend accounts; and notify affected users if material misrepresentation or breaches are identified.

Indemnity

You will indemnify TenantSphere for losses arising from inaccurate or unauthorized listings or IP/privacy violations.

6. Third‑Party Services

The Service links to or integrates third‑party services (payments, storage, analytics, identity verification). We are not responsible for their content, terms, or policies. Your use is governed by their terms.

7. Subscriptions, Fees, and Taxes

Certain features require paid subscriptions or fees (e.g., visitation fees, commissions). Prices are shown in XAF unless stated otherwise and may change.

Fees are payable in advance and are generally non‑refundable unless required by law or expressly stated.

You are responsible for taxes and operator/network fees.

8. Online Payments & Mobile Money (XAF)

Payments are processed by Payment Processors and mobile money operators (e.g., MTN MoMo, Orange Money) subject to their onboarding, KYC, limits, fees, and terms.

Funds are held/settled by the Payment Processor or its financial institution partners, not by TenantSphere.

Reversals/Disputes

Payments may be reversed (payer dispute, bank reversal, fraud, non‑compliance). You are liable for resulting deficits, fees, and costs. We may debit a linked method, offset balances, suspend features, or require additional verification.

Fraud & Risk

We may delay, decline, reverse, or limit transactions where suspected risk or policy breaches arise. Contact support to request a review.

TenantSphere is not a debt collector and does not guarantee tenant payments or lease performance.

9. Bank Connections

If you connect a bank/financial account, you authorize the provider to share selected financial data with us. Authentication occurs on provider pages; disconnect anytime.

Availability of bank‑connect features in Cameroon may vary by provider/region.

10. AI‑Assisted Features

AI outputs may be inaccurate or incomplete and are provided as‑is for convenience. Do not rely on AI for legal, tax, or accounting advice.

Do not input unlawful or highly sensitive data unless necessary and authorized.

We may change or suspend AI features at any time.

11. Support

We aim to respond within a reasonable timeframe but do not guarantee specific SLA. Support is not legal, tax, or accounting advice.

Staff may access your Account data to troubleshoot or provide support.

12. Acceptable Use and Conduct

  • Prohibited: harassment, discrimination, hate speech, fraud, misleading practices, illegal activities.
  • Comply with housing, consumer, anti‑discrimination, data protection, and other applicable laws.
  • We may remove content, restrict features, or suspend Accounts for violations.

13. Disclaimers

The Service (including Verified Listings and TenantSphere Listings) is provided as is and as available. While we verify landlord‑submitted listings and vet/train TenantSphere Agents, we do not warrant uninterrupted, error‑free operation or complete accuracy.

Verification is limited to Section 6A checks; it is not a substitute for your own inspections or legal review.

Property condition, title, neighborhood factors, and legal compliance are the responsibility of landlords/tenants/agents. Seek professional advice when needed.

14. Limitation of Liability

To the maximum extent permitted by law, TenantSphere is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business. Our aggregate liability for all claims in any 12‑month period is limited to the total fees you paid to TenantSphere in that period for the specific Service giving rise to the claim.

15. Indemnity

You will indemnify and hold harmless TenantSphere, its affiliates, and personnel from claims, losses, damages, and costs (including reasonable legal fees) arising from your: (a) breach of these Terms or law, (b) Data or content, (c) use of the Service, or (d) disputes with other users.

Landlords/Agents specifically indemnify TenantSphere for claims arising from inaccurate/unlawful listings, lacking authority to advertise/let, or breach of Section 6B.

16. Termination & Suspension

We may suspend or terminate your Account or access at any time for breach, risk, non‑payment, legal request, or technical/security reasons.

You may cancel anytime; fees already paid are non‑refundable unless required by law. Upon termination, your right to use the Service ends.

17. Data Ownership, Retention, and Deletion

You own your Data and grant us rights needed to operate the Service.

You are responsible for backups. We use reasonable safeguards but do not guarantee no data loss.

Post‑termination, we may retain data as required by law or for legitimate business purposes, then delete or anonymize per our Privacy Policy. You may request deletion where applicable.

18. Confidentiality

Each party must keep the other’s confidential information secret, using it only to perform under these Terms, unless disclosure is required by law.

19. Force Majeure

Neither party is liable for delays caused by events beyond reasonable control (e.g., outages, strikes, regulatory actions, natural disasters).

20. Assignment

We may assign these Terms. You may not assign without our prior written consent.

21. Notices

We may notify you by email or in‑app. Keep your contact details current. Your notices to us must be sent to support@tenant-sphere.com (or as specified on our Website).

22. Changes to the Service and Terms

We may modify, suspend, or discontinue features. We may update these Terms and will post the effective date. Continued use constitutes acceptance.

23. Governing Law and Jurisdiction (Cameroon)

These Terms are governed by the laws of the Republic of Cameroon. The courts of Douala, Cameroon, shall have exclusive jurisdiction, subject to any mandatory consumer protections.

Where payment or financial services are implicated, applicable CEMAC/BEAC regulations and operator terms may also apply.

24. Language

TenantSphere may provide these Terms in English and French. In case of inconsistency, the English version controls unless Cameroonian law requires otherwise.

25. Entire Agreement; Severability; No Waiver

These Terms and the Privacy Policy constitute the entire agreement, superseding prior understandings. If any provision is unenforceable, the remainder remains in effect and the provision will be modified to the minimum extent necessary. Failure to enforce a provision is not a waiver.
